Terms and Conditions

1. Scope
These Terms and Conditions apply to all orders placed through philipphufschmid.com with Philipp Hufschmid. The seller is Philipp Hufschmid.

2. Formation of contract
The product listings in this shop do not constitute a binding offer; they are an invitation for you to place an order. By submitting your order, you make a binding offer to purchase. The contract is concluded once we accept your order, either by sending a confirmation email or by shipping the item.

3. Prices and shipping costs
All prices shown include statutory VAT. Shipping costs are shown separately at checkout before you complete your order.

4. Payment
Payment is made via the methods offered at checkout. The purchase price is due upon conclusion of the contract.

5. Delivery
Delivery is subject to our Shipping Policy. For consumers, the risk of loss or damage in transit passes to you only once the goods are delivered.

6. Retention of title
The delivered goods remain our property until payment has been received in full.

7. Nature of handmade work
Every piece is hand-built and one of a kind. Minor variations in size, colour, pattern or glaze compared to the product photo are a natural result of the making process and do not constitute a defect.

8. Warranty
Statutory warranty rights apply. For consumers, the limitation period for warranty claims on newly manufactured goods is two years from delivery.

9. Liability
We are liable without limitation for intent and gross negligence, and under the Product Liability Act. For slight negligence, we are liable only for breach of a material contractual obligation, limited to foreseeable, contract-typical damage.

10. Dispute resolution
We are not obliged, and not willing, to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final provisions
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country where you have your habitual residence remain unaffected.
